TCPA and CAN-SPAM Compliance Considerations

TCPA and CAN-SPAM are two of the most relevant laws that impact companies who want to launch digital marketing, email, phone and/or text messaging campaigns. Failure to comply can result in significant regulatory enforcement actions and penalties, as well as class action risk. This program will focus on considerations healthcare providers and counsel should be aware of when navigating TCPA and CAN-SPAM compliance.

 

Join AzSHA and speaker attorneys Patrick Kelly and Tony Caldwell for a 1-hour webinar that will cover:

  • Use of auto-dialers and pre-recorded messages following the 2021 U.S. Supreme Court’s Decision in Facebook v. Duguid
  • Recent FTC guidance
  • TCPA Healthcare messages exception
  • Best practices when advising healthcare clients on marketing campaigns

 

Patrick Kelly, a partner with Snell & Wilmer in Los Angeles, concentrates his practice in business and commercial litigation, with an emphasis in contract disputes and claims relating to corporate, franchise, and partnership disputes, real estate disputes, and uniform commercial code issues, including the Telephone Consumer Protection Act (TCPA). He has represented a range of clients that includes franchisors, financial institutions, developers, insurance companies, clothing manufacturers, actors and athletes, general contractors, and suppliers and distributors. He is a member of Snell & Wilmer’s Commercial Litigation Practice Group and TCPA Practice Group with first chair trial experience. Patrick was recently named to Best Lawyers in America® for Commercial Litigation.

Tony Caldwell, an associate with Snell & Wilmer in Phoenix, helps clients navigate complex issues related to law and technology. His day-to-day practice focuses on corporate, technology and life sciences transactions and contracting matters. He advises international and U.S. companies with data privacy and healthcare regulatory matters, and he routinely assists companies with issues and drafting policies related to the GDPR, California Consumer Privacy Act, TCPA, COPPA, CAN-SPAM, PIPEDA, HIPAA, and HITECH. He is a member of the firm’s Cybersecurity, Data Protection and Privacy Practice Group. Tony was recently named to Best Lawyers in America®: Ones to Watch for Health Care Law.

From there, select the applicable program and scroll down to “Tickets.” You will need to log in to purchase whether you are a member or not.
