Cyberattacks and data breaches involving confidential client information, where such information is misappropriated, destroyed or otherwise compromised are increasingly commonplace. These attacks may impair clients’ and their lawyers’ ability to perform services and expose them to financial damages. A lawyer must act promptly and reasonably to intervene to stop the breach and to mitigate the harm. The speakers will discuss ethical and practical approaches that attorneys may take in preventing and addressing cyberattacks and data breaches in remote working environments, dealing with ransomware and those who are behind it, and what is required when there is a data breach when serving as a business associate.
Presenters:
James Melendres is a Partner at Snell & Wilmer. He co-chairs the Investigations, Government Enforcement and White Collar Protection practice and Cybersecurity, Data Protection and Privacy practice. He regularly conducts internal investigations and represents companies in a wide variety of matters relating to federal and state criminal, civil and regulatory enforcement. James also advises companies regarding the full life cycle of enterprise risks associated with cybersecurity, including before, during and after a data breach or other cyber-attack.
John Gray is Of Counsel with Lewis Roca. As a Certified Information Privacy Professional, John represents clients in a wide range of privacy and cybersecurity matters, including litigation across California and Arizona. Before joining Lewis Roca, John served as the Data Privacy Team Leader for the Arizona Attorney General’s Office and as Co-Chair of the Technology Futures Subgroup for the Arizona Cybersecurity Team. He also drafted much of Arizona’s current data-breach notification law and advises clients regarding compliance with that law and various other state, federal, and international privacy and security obligations.
Paul Giancola is Of Counsel with Snell & Wilmer, LLP and an Adjunct Faculty at the Sandra Day O’Conner College of Law where he teaches Health Care Fraud Law. Paul’s health care practice is focused on providing regulatory counsel on fraud and abuse laws, compliance, government investigations and audits, contractual matters, HIPAA privacy and cybersecurity, and transactional health care matters including joint ventures, practice/entity formation, acquisition and separations, ambulatory surgery centers and laboratories. Paul also has extensive experience in medical staff and peer review matters.
