How the Recent Supreme Court Decisions have Changed the Game for False Claims Act Cases

Lon Leavitt, Assistant United States Attorney, Brett Johnson, Partner at Snell & Wilmer, Nick Verderame, Associate at Plattner Verderame, and Claudia Stedman, Associate at Snell & Wilmer will discuss the impact of the recent Supreme Court decisions in SafewaySuperValuPolansky (among others) on the future of the False Claims Act (“FCA”) and its enforcement. This program will be presented in an interactive, Q & A format to provide AzSHA members with valuable perspectives from all sides of the FCA.

Lon R. Leavitt is an Assistant United States Attorney for the District of Arizona.  Lon represents the federal government’s interests in civil fraud matters, primarily False Claims Act investigations, cases, and qui tam actions involving Medicare and other federal programs.  He is also the Civil Health Care Fraud Coordinator and the Affirmative Civil Enforcement Coordinator for the District of Arizona.  During his many years as an Assistant United States Attorney, Lon has handled dozens of health care fraud and other cases resulting in substantial recoveries for the United States.  Lon also served as a Special Assistant United States Attorney in the District of Nevada and has experience representing relators nationwide in False Claims Act qui tam actions.

He has received several awards and commendations for his work and has given numerous presentations and training sessions at national and regional conferences to audiences both inside and outside the government.

 

Brett Johnson is a Partner at Snell & Wilmer, LLP. Brett represents businesses and individuals in government relations matters, including government contracting and false claims investigations. Brett regularly represents parties and witnesses involved with governmental investigations. He has experience handling internal investigations and compliance audits for clients on a wide range of matters, while also enhancing corporate compliance programs. Brett also provides training to businesses and governmental agencies concerning compliance matters.

Brett serves on Snell & Wilmer’s Executive Committee, is the Practice Group Chair for the Special Litigation & Compliance group at Snell, and serves as the Co-Chair of Snell’s International Industry practice group. Brett is also co-editor of the firm’s International Industry group’s Global Connection newsletter.

Brett received his J.D. from the Santa Clara University School of Law, LLM from the University of San Diego School of Law, and Masters in International Management from the University of Maryland, University College.

 

Nick Verderame is an attorney at Plattner Verderame. He focuses his practice in plaintiffs’ personal injury litigation and False Claims Act cases. Nick is a member of the State Bar of Arizona, the Arizona Association for Justice (formerly the Arizona Trial Lawyers Association) and the American Association for Justice (AAJ). He currently serves on the AAJ’s Board of Trustees and Board of Governors, as well as several committees.

Nick spends his time away from the office traveling and playing with his children, as well as coaching their teams. Being an attorney is his second career – he was originally a broadcast journalist at both CBS News and ESPN.

 

Claudia Stedman is an associate at Snell & Wilmer, LLP where her practice is focused in healthcare compliance and regulatory matters, litigation, and transactions. Claudia assists providers with federal payor regulatory compliance, HIPAA compliance, and False Claims Act compliance. In this capacity, she assists providers and healthcare entities in responding to government investigations, audits, overpayments, and suspensions. Claudia regularly assists clients in conducting internal audits, structuring compliance plans, and strategizing how to appropriately license healthcare entities to comply with state and federal law.

Claudia is a member of Snell’s attorney development committee and is a mentor for the firm’s Fellowship for Advancement and Resources program.

Claudia received her J.D. from the University of Notre Dame and her Bachelor of Arts from the University of Pennsylvania.
