The expansion of telehealth services is undoubtedly a silver lining of the pandemic. The speakers will discuss the Federal telehealth waivers and flexibilities adopted in response to the pandemic; the expansion of telehealth in Arizona as a result of HB 2454; considerations under state licensure requirements and waivers; issues related to the delivery of health care services via telehealth after the end of the Public Health Emergency; and potential medical professional liability risks and telemedicine risk reduction strategies.
Presenters:
Jeanne Varner Powell – As a medical malpractice defense attorney, Jeanne represented hospitals and health care professionals for nearly 20 years. In 2020, she left litigation to join Mutual Insurance Company of Arizona (MICA) as the Senior Legal Risk Management Consultant. In this position, she writes, speaks, and consults directly with insured physicians and practices on medical professional liability risk management.
Claudia Stedman is an associate at Snell & Wilmer in the special litigation and compliance group, where her practice is focused in health care compliance and regulatory matters, litigation, and transactions.
Claudia has experience in Medicare and Medicaid enrollment and compliance, Stark and Anti-Kickback compliance and risk-management, HIPAA compliance, and False Claims Act compliance. She has assisted in representing hospitals, individual providers, and pharmacies in malpractice matters. Claudia also has represented providers in various professional licensing board matters.
In her regulatory practice, Claudia has worked with both state and federal agencies, including the Arizona Department of Health Services (ADHS), the Arizona Health Care Cost Containment System (AHCCCS), the Arizona State Board of Pharmacy, the Drug Enforcement Agency (DEA), the Centers for Medicare & Medicaid Services (CMS), the Office of the Inspector General, Department of Health and Human Services (HHS OIG), and the Department of Justice (DOJ). In this capacity, she has assisted in advising clients on how to respond to government investigations, conduct internal audits, structure internal compliance programs, and how to appropriately license healthcare entities to comply with state and federal law.
Claudia has experience in drafting and negotiating various types of healthcare contracts, including employment agreements, clinical trial agreements, medical director agreements, and service agreements. In the field of telehealth, Claudia has assisted providers and healthcare practices in complying with both intra-state and cross-state licensing requirements and helps providers understand the various licensure compacts and ever-changing regulatory and legislative landscape that may affect providers’ telehealth practice. Claudia also has regulatory and compliance experience in the fields of remote patient monitoring and direct primary care/concierge medicine.
Miranda Preston is a transactional attorney, and a shareholder at Milligan Lawless, P.C. She primarily represents clients in the health care and life sciences industries. Her work includes negotiating and drafting transaction documents and advising clients on the legal aspects of day-to-day operations, including general corporate matters; Anti-kickback Statute and Stark Law issues; HIPAA; False Claims Act; the Anti-Markup Rule; fee-splitting prohibitions; telehealth policies and procedures; licensure requirements; and compliance with CMS billing rules. She has substantive experience in representing buyers and sellers in the sale or purchase of health care entities or lines of business. She serves as chief outside counsel for a clinical research organization and advises clients on regulatory and transactional issues related to clinical trials.
