I have a client I’d like to refer to an attorney that’s experienced in the area of online website hosting / SAS products (specifically a white-label preferred reseller agreement), to assist the client with ensuring their subscribers’ PHI is protected, and drafting terms of use for their public-facing healthcare-related website and hosting platform. My initial assessment is that the licensor has not indicated they meet certain industry certifications and there does not even appear to be a BAA, but even more concerning is an AI provision. I know there’s a presenter coming up that might be able to advise on this type of contract, but is there anyone licensed in AZ on this forum who reviews these type of agreements regularly?
