The Territorial Abortion Ban: Up-to-the-Minute Status Report and a Look at Tough Provider Issues

On April 9, the Arizona Supreme Court declared in Planned Parenthood v. Mayes that Arizona’s old, nearly total abortion ban would become the law of the state. The Arizona legislature quickly repealed the law (repeal signed May 2). This turn of events eventually will put the 15-week limit on abortions back in place, but the situation is still very fluid. Despite the repeal, the territorial ban may go into effect in June and remain on the books for some 90 days after the legislative session ends, unless the Arizona Supreme Court issues a stay. Add to this the likelihood of an initiative on the ballot this fall to reinstate Roe v. Wade’s standards, the legislature’s move toward putting competing referenda on the ballot, and the U.S. Supreme Court’s consideration of whether EMTALA preempts state abortion law and the availability of medical abortions, and providers continue to face complex challenges as they try to care for patients.

Andy Gaona, the attorney who argued for Planned Parenthood before the Supreme Court in the Mayes case, has agreed to speak about the case, timing of implementation of the ban, enforcement questions, and the initiative — expected to make it onto the ballot in November — that would end the ban and put Roe v. Wade’s standards into the state constitution.

Marki Stewart, an attorney with a significant reproductive health law practice, will join Andy and discuss the complex provider compliance issues inherent in implementation of the territorial ban.  Marki will cover issues related to treatment standards and the very limited exemptions that exist, referrals, and the intersection of the territorial ban with other Arizona abortion statutes.

Andy Gaona and Marki Stewart are both attorneys in private practice at the Phoenix law firm of Coppersmith Brockelman PLC.  Andy focuses his practice on election, political, and public law. He advises candidates, political action committees, political party organizations, nonprofits, and government entities on issues of campaign finance, ballot access, election mechanics, and election-related litigation.  He’s also a seasoned appellate litigator.

Marki assists hospitals, physician groups, ambulatory surgery centers, telemedicine providers, and other health care organizations with a variety of health care regulatory and operations issues, including reproductive health law in Arizona in the wake of the Dobbs decision.
