Legal and Health Care Repercussions of Public Health Emergency Recissions

On January 30, 2023, President Biden and the Secretary of Health and Human Services announced the federal Public Health Emergency (PHE) that has been in place since January 31, 2020 would end on May 11, 2023. With nearly 300 American deaths each day from COVID-19 in Spring 2023, the implications of losing increased federal support, state flexibilities, and enhanced government authorities are vast.

The PHE and other federal, state, tribal, and local emergencies allowed governments to waive and modify certain requirements, authorize medical countermeasures, and provide increased liability protections to health care workers and entities. Employers were subjected to required and optional changes for group health and other plans. Millions of Americans gained access to care through Medicaid expansions and other related routes, with a record low number of uninsured individuals. COVID-19 vaccines, tests, and treatments were covered with little or no cost-sharing for most Americans. Many of these reforms will end on May 11, but many more will stay in place, at least temporarily.

In this session, attendees will learn an overview of federal, state, local, and tribal emergency authorities, including the types of emergency declarations and their core components, as well as key governmental powers and flexibilities enabled by these declarations. Additionally, attendees will understand which powers and flexibilities are ending, and what will remain in place following the expiration of the PHE on May 11.

Erica N. White, J.D. is a Research Scholar with the Center for Public Health Law and Policy at the Sandra Day O’Connor College of Law at Arizona State University and Senior Attorney with the Western Region Office of the Network for Public Health Law. Erica focuses her research on public health policy, emergency legal preparedness, administrative and constitutional issues in public health law.

Alex Demyan serves the Arizona Health Care Cost Containment System (AHCCCS) as Interim Assistant Director of the Division of Community Advocacy and Intergovernmental Relations (DCAIR). In this role, Alex oversees the agency’s two advocacy departments; the Office of Individual and Family Affairs (OIFA) and the Office of Human Rights (OHR), as well as the agency’s federal relations unit. Alex brings experience in non-profits, federal block grants, the behavioral health field, and the public policy realm. During that time, he has become a leader in Medicaid public health policy for a variety of populations. Alongside his Medicaid colleagues, he has led the agency through attaining a variety of federal authorities in response to the COVID-19 pandemic, helped shape and negotiate AHCCCS’ recent 1115 renewal and amendment, led stakeholder engagement for major agency initiatives, and assisted in health policy development that has a direct impact on members. Alex is a graduate of both Northern Arizona University and Arizona State University.
