Homchick (Davis Wright Tremaine) and S. Craig Holden (Baker Donelson) \nAfternoon Session: This year’s conference will feature four afternoon breakout session rooms with the option of attending up to two of the following programs: \n\nFraud and Abuse: Stark\, AKS and EKRA\nCorporate Compliance and Governance (Ethics Credit): Implementing a corporate compliance program and navigating government investigations\nExecutive Professional Board Panel: Audit Trends and Enforcement from the Executive Directors of Arizona’s Professional Boards\nPrivacy\, Security and Patient Access Laws: HIPAA\, ONC/CMS Interoperability requirements\, 42 CFR Part 2 and state health laws\nHealth Care Transactions: Fundamentals in health care contracts\nBehavioral Health Developments: Survey of all things behavioral health\nMedicare/Medicaid Reimbursement and Related Topics\nPharmacy Law Panel: Survey of pharmacy law developments and core legal/compliance issues\, including a case law update\n\nWe will post an agenda with updated presentation titles and descriptions\, as well as presenter names and bios prior to the conference date. \nNetworking Opportunities\nAttendees are invited to stay after the conference to network with local attorneys and compliance personnel while enjoying light appetizers and an open wine/beer bar. The networking event will be held in an outdoor setting at the same location as the conference. Attendees are also encouraged to join us and their colleagues for coffee in the morning and lunch in the afternoon. A box lunch will be served in between the morning and afternoon session. Outdoor seating is available.\n \nConference Format and Safety Precautions\nThis will be an in-person event. At this time\, there are no plans for virtual attendance. However\, conference registrants who are either unable to attend in person or would prefer not to attend in person will have access to recordings of the presentations. Consistent with CDC guidance\, all attendees must show proof of vaccination or obtain a negative COVID-19 test within 72 hours of the event. You can send a copy of your vaccination card or negative test results to us in advance at azhealthcareattorneys@gmail.com. Attendees will need to wear a face mask\, except when eating or drinking. \nPer ASU’s COVID-19 guidelines\, all attendees must ask themselves the following questions the day of the event and prior to arriving in person: \n\n\n\n\nASU Mandatory Screening Questionnaire \n  \nBe honest; if you can say “yes” to any of these\, please do not go inside. Go home and contact your health care provider and your supervisor before returning to campus. SUMMARY:Selected Cybersecurity Issues for Attorneys
DESCRIPTION:Cyberattacks and data breaches involving confidential client information\, where such information is misappropriated\, destroyed or otherwise compromised are increasingly commonplace. These attacks may impair clients’ and their lawyers’ ability to perform services and expose them to financial damages.  A lawyer must act promptly and reasonably to intervene to stop the breach and to mitigate the harm.  The speakers will discuss ethical and practical approaches that attorneys may take in preventing and addressing cyberattacks and data breaches in remote working environments\, dealing with ransomware and those who are behind it\, and what is required when there is a data breach when serving as a business associate. \nPresenters: \nJames Melendres is a Partner at Snell & Wilmer. He co-chairs the Investigations\, Government Enforcement and White Collar Protection practice and Cybersecurity\, Data Protection and Privacy practice. He regularly conducts internal investigations and represents companies in a wide variety of matters relating to federal and state criminal\, civil and regulatory enforcement. James also advises companies regarding the full life cycle of enterprise risks associated with cybersecurity\, including before\, during and after a data breach or other cyber-attack. \nJohn Gray is Of Counsel with Lewis Roca.  As a Certified Information Privacy Professional\, John represents clients in a wide range of privacy and cybersecurity matters\, including litigation across California and Arizona.  Before joining Lewis Roca\, John served as the Data Privacy Team Leader for the Arizona Attorney General’s Office and as Co-Chair of the Technology Futures Subgroup for the Arizona Cybersecurity Team.  He also drafted much of Arizona’s current data-breach notification law and advises clients regarding compliance with that law and various other state\, federal\, and international privacy and security obligations. \nPaul Giancola is Of Counsel with Snell & Wilmer\, LLP and an Adjunct Faculty at the Sandra Day O’Conner College of Law where he teaches Health Care Fraud Law. Paul’s health care practice is focused on providing regulatory counsel on fraud and abuse laws\, compliance\, government investigations and audits\, contractual matters\, HIPAA privacy and cybersecurity\, and transactional health care matters including joint ventures\, practice/entity formation\, acquisition and separations\, ambulatory surgery centers and laboratories. SUMMARY:Collateral Consequences for Physicians
DESCRIPTION:A discussion of the collateral consequences to health care professionals following action by medical boards\, hospitals\, health plans\, the DEA and the criminal process. \nBarry Mitchell is a 30-year trial lawyer focusing on criminal\, regulatory\, and administrative cases. Barry is particularly skilled in defending cases with an intersection between criminal and regulatory/administrative issues. He has represented hundreds of licensed professionals and entities facing matters ranging from domestic violence to money laundering. He has also handled internal investigation and compliance issues for organizations ranging from small companies and practice groups to Fortune 100 corporations. Before starting Mitchell | Stein | Carey | Chapman\, Barry practiced for 22 years at Gallagher & Kennedy\, P.A.\, and was a partner in its Criminal Law and Regulatory Enforcement Group. \nSteve Myers has represented physicians hundreds of times in connection with peer review proceedings at most of the hospitals in Arizona and has represented physicians 1\,000 or more times before the Arizona Medical Board and Arizona Board of Osteopathic Examiners in Medicine and Surgery. Many former Medical Board Chairs of the Arizona Medical Board have referred their partners and colleagues to Steve for representation before the Board.
