SUMMARY:Healthcare Workplace Violence: Legal and Practical Responses in Arizona
DESCRIPTION:Healthcare workplace violence is\, most unfortunately\, a daily occurrence affecting healthcare provider staff in Arizona and across the nation. The problem became even more widespread and acute during the worst of the COVID pandemic\, and as hospitals and clinics are filling up again this winter\, it is top of mind for healthcare workers and employers. SUMMARY:Behavioral Health Law: An Introduction
DESCRIPTION:Behavioral health care law is one of the most interesting and quickly growing areas of health care law. This session will serve as an introduction to behavioral health law in our home state of Arizona and across the country. SUMMARY:Responding to Patient Access Requests in Compliance with HIPAA and the Information Blocking Rule
DESCRIPTION:HIPAA grants individuals the legal right to “access” their PHI. This includes a right to inspect and obtain a copy of PHI in paper and electronic format\, and to direct such PHI be transmitted to an identified third party.  There are only a few narrow exceptions to this HIPAA right. The Office of National Coordinator worked closely with the Secretary of Health and Human Services when drafting the Information Blocking Rule to ensure its alignment with HIPAA. SUMMARY:Dobbs v. Jackson Women’s Healthcare Organization:  Legal and Practical Issues
DESCRIPTION:Without question\, the Dobbs case\, which overruled Roe v. Wade and Casey v. Planned Parenthood\, has rocked the country and raised very serious questions not only for patients\, but also for providers\, employers\, insurers and of course healthcare lawyers. DESCRIPTION:This year’s annual legislative update program will focus on state legislation from the busy 2022 legislative session. As well\, we’ll provide a preview of this year’s election and what it may mean for the next two years in the policymaking arena. This will be a 90-minute session because of the amount of material to be covered. \nJason Bezozo is the Vice President for Government Relations at Banner Health.  He worked at the Arizona State Senate as the Senior Legislative Research Analyst for the Senate Health Committee and as Assistant Director for the Senate Research Staff. He joined the Arizona Hospital and Healthcare Association in 2002 as the Director of Government Affairs and Policy and then joined Banner Health in 2006 to manage government relations across the health care system. Jason has a history degree from ASU and a Master’s in business administration from University of Phoenix. \nMeghan McCabe is the Director of Government Relations for the Arizona Hospital and Healthcare Association. SUMMARY:COVID-19 Vaccine Mandates: Key Legal Issues\, Practical Strategies\, & the Future of Law and Policy

DESCRIPTION:The expansion of telehealth services is undoubtedly a silver lining of the pandemic. The speakers will discuss the Federal telehealth waivers and flexibilities adopted in response to the pandemic; the expansion of telehealth in Arizona as a result of HB 2454; considerations under state licensure requirements and waivers; issues related to the delivery of health care services via telehealth after the end of the Public Health Emergency; and potential medical professional liability risks and telemedicine risk reduction strategies. \nPresenters: \nJeanne Varner Powell – As a medical malpractice defense attorney\, Jeanne represented hospitals and health care professionals for nearly 20 years. In 2020\, she left litigation to join Mutual Insurance Company of Arizona (MICA) as the Senior Legal Risk Management Consultant. In this position\, she writes\, speaks\, and consults directly with insured physicians and practices on medical professional liability risk management. \nClaudia Stedman is an associate at Snell & Wilmer in the special litigation and compliance group\, where her practice is focused in health care compliance and regulatory matters\, litigation\, and transactions. \nClaudia has experience in Medicare and Medicaid enrollment and compliance\, Stark and Anti-Kickback compliance and risk-management\, HIPAA compliance\, and False Claims Act compliance. SUMMARY:Selected Cybersecurity Issues for Attorneys
DESCRIPTION:Cyberattacks and data breaches involving confidential client information\, where such information is misappropriated\, destroyed or otherwise compromised are increasingly commonplace. These attacks may impair clients’ and their lawyers’ ability to perform services and expose them to financial damages.  A lawyer must act promptly and reasonably to intervene to stop the breach and to mitigate the harm.  The speakers will discuss ethical and practical approaches that attorneys may take in preventing and addressing cyberattacks and data breaches in remote working environments\, dealing with ransomware and those who are behind it\, and what is required when there is a data breach when serving as a business associate. \nPresenters: \nJames Melendres is a Partner at Snell & Wilmer. He co-chairs the Investigations\, Government Enforcement and White Collar Protection practice and Cybersecurity\, Data Protection and Privacy practice.
