Why Arbitrate: Fundamentals of Healthcare Arbitration: The Good, the Bad, and the Ugly

Patrick Welsh and Paul Giancola present a practical introduction to arbitration in the healthcare context, focusing on how arbitration clauses are used, negotiated, and construed under Arizona and federal law. Attendees will gain insight into the relevant laws, the rulesets of several major arbitration bodies, key considerations for effective drafting,  as well as strategic considerations unique to healthcare disputes—such as discovery, confidentiality concerns, how an arbitration differs from a court case, the expectations of arbitrators, and mediation and alternative arbitration methods. Designed for lawyers who advise healthcare organizations, physicians, and related entities in Arizona, the session emphasizes real-world application, risk mitigation, and best practices for using arbitration as an effective dispute resolution tool.

Patrick Welsh is assistant general counsel at HonorHealth, where he handles health care transactions and compliance, as well as real estate and construction issues. He is author of the forthcoming legal treatise The Law of Renewals, to be published by the Arizona State Bar Association. Prior to joining HonorHealth, Patrick was in private practice, representing health care organizations and individual practitioners in litigation and arbitration.

Paul Giancola is Of Counsel with Snell & Wilmer, LLP. Paul’s health care practice is focused on providing regulatory counsel on fraud and abuse laws, compliance, government investigations and audits, contractual matters, medical staff and peer review matters, HIPAA privacy and cybersecurity, and transactional health care matters including joint ventures, practice/entity formation, acquisition and separations, ambulatory surgery centers and laboratories. Paul also has extensive experience as a mediator and arbitrator.

Location

This program will be a hybrid program with both an in-person and virtual option. Please select the appropriate ticket for whether you intend to be in-person or virtual. Lunch will be provided to those in-person. The Zoom information will only be provided to those who purchase virtual tickets.

To Register

Regardless of membership, you must login to purchase tickets. To do so:

  1. Under ticket information, click “login to purchase”
  2. This will take you to the login page. If you are a member, use the login information utilized for your membership. If you are a non-member, you will need to create an account to purchase a ticket. Non-members who have not created an account yet, must select “Register” along the bottom next to “Lost your password?”
  3. From there, you will create an Account by entering a username, name, email address, and password. Then select “Complete Sign Up.”
  4. The account will need to be activated by using the link in a confirmation email sent to the registered email address. Once the account is activated, you will login using the credentials provided (username and password).
  5. Once logged in, navigate to the Program page and select the number of tickets needed and select “Get Tickets” to proceed with the checkout process.
